If you qualify for Chapter 7, you will get a "fresh start," meaning most of your unsecured debts, and the secured debts you no longer want to maintain will be wiped out. In most instances you can keep your house and your car if you continue to make payments.

In a Chapter 13, you will have to pay back a percentage of your unsecured debts over a three or five year period, but you will be allowed to protect equity in certain property. Chapter 13 is useful for those individuals who earn a steady income and either do not qualify for Chapter 7 or have equity in real estate or other property they may lose in a Chapter 7.
