Family Law

Divorce can be a very complicated process. Pirogovsky Fremderman, Ltd. will advise its client with sympathy throughout the process and counsel when the parties cannot resolve divorce issues amicably. If you and your spouse have an agreement on most of the issues, however, Pirogovsky Fremderman, Ltd. will draft a court document, Settlement Agreement, to memorialize and reflect that agreement to avoid unwanted setbacks and difficulties in the future regarding property division and financial support, if any.

Pirogovsky Fremderman, Ltd. is sensitive to the fact that children of separated or divorced parents do better if both parents stay actively involved in their children's lives. Conflict is not good for your children because the way you and the other parent act affects them. Both parents should answer children's questions honestly, but avoid saying things they don't need to know. It is important that each parent includes the other in school and other activities without conflict. Pirogovsky Fremderman, Ltd embraces the idea that its clients should encourage a relationship between the children and the other parent. Pirogovsky Fremderman, Ltd. will help you to develop a parenting plan that gives your children time and access to both parents.

Pirogovsky Fremderman, Ltd. will also assist with child adoptions. Pirogovsky Fremderman, Ltd. will explore different options to determine the best legal route for an adopting family wanting to adopt a child, a pregnant woman or birth mother needing help to reach their goals and help you in every way possible with adoption of a child. Pirogovsky Fremderman, Ltd. will insure that its client feels comfortable and understands how the adoption process works.

Pirogovsky Fremderman, Ltd. also provides other family-law related legal services such as prenuptial, postnuptial agreements and name changes.

Wills and Trusts

Pirogovsky Fremderman, Ltd. offers its legal expertise in connection with wills, trusts and estate planning. While Pirogovsky Fremderman, Ltd. appreciates the fact that many people procrastinate and hesitate to think about the transfer of their property upon death, if they do not make timely arrangements, state law will determine what happens to their property. Generally, property will go to one's spouse and children or, if there are none, to other close relatives. If no close relatives can be found to inherit the property, it will go to the State. To avoid this undesired outcome, Pirogovsky Fremderman, Ltd. will assist its clients with a simple approach of drafting a will and attendant documents, such as trusts, financial and healthcare powers of attorney. Even in situations where it is clear who receives the property, it is still in the best interest of your heirs to create a will in order to appoint an administrator to deal the estate's creditors and to avoid certain court fees.

Pirogovsky Fremderman, Ltd. will assist in a situation where both parents of a child die or become otherwise unable to care for a minor child to set up personal guardianship. The personal guardian will be responsible for raising your children until they become legal adults. Pirogovsky Fremderman, Ltd. will ensure that its clients, while creating a will, nominate personal guardians to protect their children from possible conflicts with the State. You can choose the same guardian to manage whatever property the child inherits, or you can name someone different in the will.

Pirogovsky Fremderman, Ltd. will represent clients to defend wills if wills are challenged. Wills may be challenged by a close relative who feel cheated out of a share of a deceased person's property.

Pirogovsky Fremderman, Ltd. will also provide legal services in connection with setting up lifetime property and/or land trust and estates.
